  • Your signature: An electronic or physical signature of the person authorised to act on behalf of the copyright owner.

Incomplete notices — those missing any of the above elements — may not qualify for DMCA safe harbour protections and may delay our ability to act on your claim. Please ensure your notice is complete before sending.

3. How Techxomos Responds to Valid DMCA Notices

When we receive a DMCA notice that contains all required elements and appears to represent a legitimate copyright claim, we will take the following steps:

  • Prompt removal: We will remove or disable access to the allegedly infringing content as quickly as reasonably practicable, typically within 2 to 5 business days of receiving a complete and valid notice.
  • User notification: Where applicable, we will inform the person who submitted or is associated with the removed content that it has been taken down and provide the reason for the removal.
  • Record keeping: We maintain an internal record of all DMCA notices received, actions taken, and counter-notices filed, in accordance with applicable law.
  • Right of counter-notice: We will inform the affected party of their right to file a counter-notice if they believe the removal was made in error.

Please note that submitting a false or misleading DMCA notice is a serious legal matter. Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and legal fees.

4. Filing a Counter-Notice

If you are the person whose content was removed and you believe the takedown was made in error — for example, because you own the rights to the content, or because the use constitutes fair use under applicable copyright law — you have the right to submit a counter-notice.

A valid DMCA counter-notice must include:

  • Your full name, mailing address, telephone number, and email address.
  • Identification of the specific content that was removed and the URL where it appeared before removal.
  • A statement, made under penalty of perjury, that you have a good faith belief that the content was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Techxomos may be found, and that you will accept service of process from the person who filed the original DMCA notice.
  • Your electronic or physical signature.

Please write "DMCA Counter-Notice" in the subject line. Upon receiving a valid counter-notice, we will forward it to the original complainant and, unless they notify us that they have filed a court action seeking to restrain the re-posting of the content, we may restore the removed content within 10 to 14 business days of receiving your counter-notice.

5. Repeat Infringer Policy

Techxomos maintains a strict policy regarding repeat copyright infringement. In accordance with the DMCA and other applicable laws, we reserve the right to permanently terminate, block, or restrict access for any user, contributor, or account that is found — after appropriate review — to be a repeat infringer of third-party intellectual property rights.

What constitutes a "repeat infringer" is assessed on a case-by-case basis, taking into account the nature and frequency of the infringement, whether the person acted in good faith, and whether the situation was resolved through a legitimate counter-notice.

6. Fair Use and Content Disputes

Not all uses of copyrighted material constitute infringement. Under copyright law, certain uses — including commentary, criticism, news reporting, teaching, and research — may qualify as fair use (in the United States) or fair dealing (in other jurisdictions such as India, Canada, and the UK).

7. Limitation of Liability
